Through agreement to resolve litigation dated 02/08/1994, Richmond City can
only utilize 686 gpm of water from the springs metered at Birch Creek Spring
Area.
The balance of the water during these months belongs to the Richmond
Irrigation Company and Richmond City has no means of measuring that flow.
During non-irrigation months, should any water exceed culinary demand it is
”spilled” into Cherry Creek proper.
