In accordance with Order of the State Engineer on application 35-12901 (a40202), share changes to underground sources will be evaluated in light of the river commissioner`s priority distribution cuts and may be reduced from the full nominal share quantification given above. Comments written here identify the share value as 0.764 acre per share, but the nominal volume of water associated with that acreage assuming a duty of 3 acre-feet per acre is not guaranteed inasmuch as the right may not take water out of priority and the river commissioner frequently calls for cuts to 1885 and earlier priorities (including this company`s right, which has an 1887 priority).

I called Richard Dudley this morning and he indicated he completed poring over company records and related documents and his firm finding is the 626 shares are dedicated absolutely and solely to 35-8680, for 478 acres, making the share evaluation 0.764 acre per share. The South Ditch (Mutual Association) are separate and the only tie they have with the North Ditch (i.e. Boulderville Ditch Company) is they are managed/distributed by the same water master and they share a point of diversion on the river. We can proceed with the above numbers and draft share statements accordingly.

Richard Dudley (president) visited the office today and we went over company documents, maps, and water right records. We discussed shares, shareholders, and the distribution system and acreage. Our intent is to quantify the shares so that a change application can be filed to put a share in a well for one of the shareholders. Mr. Dudley submitted a copy of the Articles of Incorporation from 1913 for our records. They are now scanned to and stored on file with 35-8680. The company issued 626 shares of stock. Their Weber River Decree right is for irrigating 478 acres. However, there is just slight uncertainty in the quantification of the acreage per share because the Boulderville Ditch Company is managed jointly with the South Boulderville Ditch Company (which is listed only as a mutual association on water right records - unincorporated). Without the South, the share evaluation would be 0.764 acre per share. Mr. Dudley is researching this and will get back to me on it.
