"GENERAL" POLICY CONSIDERATIONS

SURFACE-TO-UNDERGROUND CHANGES

1. There is a relatively close and demonstratable hydrologic connnection between the sources.

2. There is an ability to properly reduce or terminate the historic diversion and use of water from the surface source.

3. Statutory considerations under 73-3-8 (UCA).

"SPECIFIC" CONDITIONS OF APPROVAL

APPLICATIONS FOR WELLS UNDER "CHIDESTER RIGHTS"

1. The development of the well(s) under the direction of the State Engineer and limited to "bedrock" formations (no record of enforcement).

2. Surface water diversion to be equipped with a measuring device and a record of diversions to be maintained.

3. Well(s) to be equipped with measuring device(s) and a record of diversions maintained.

4. Applicant allowed to pump from well(s) only that amount that is deficient at the surface source(s).

5. The maximum amount to be diverted from the well(s) is limited by the defined beneficial use of the underlying right(s) - no enlargement allowed.

6. Applicant will be liable to compensate any water user(s) with equal or earlier priority who are adversely affected by the use of the well(s).
