DGARDNER 12/28/2023:

According to Randy Strate, HIC president, acreage to be dried up as a result of a change
application will be dried up as outlined in HIC policy #4. 



This will be specified in the Change Application Approval Agreement letter, which should
be included with each change application.



May 17, 2022: According to Randy Strate, HIC President, any shareholder that wishes to
initiate a change application for an Underground Water Well must have and present to the
Utah Division of Water Rights a share certificate that starts with a “W” (i.e. W236)
prior to a water right number being assigned for the Change Application.



June 24, 2021: According to Randy Strate, HIC president, shares in HIC cannot be changed
to part-time domestic use. 



Beginning March 2019, Horseshoe Irrigation Company (HIC) started to include with each
change application a written agreement between the shareholder and the company.  The
agreement should be signed by the shareholder and HIC and should be attached to each
change application. Item 6 of the agreement states:  ”If the State Engineer`s decision
on the change prohibits the use of part or all of these return flows to cover losses in
the distribution system, Shareholder agrees that up to twenty percent (20%) of the water
available to the shares of stock, as determined by HIC, will remain in the HIC
distribution system as carrier water to compensate for canal seepage, transportation and
operational losses and return flows to ensure that moving the water out of the HIC
system will not adversely affect the remaining stockholders in HIC.”
